Introduction :

The activity of regulation of markets is for the benefit of buyers, sellers and end consumers of agricultural produces. However, the Act could be subject to violation in some cases. For keeping control on such breaches of law, the Vigilance Department plays a very crucial role. The deputy secretary looks after the overall functioning of this department. The assistant secretary keeps a check on day-to-day activities.

Process :

Vehicles entering Mumbai without paying market fee are checked by the vigilance department. The vigilance inspectors are deputed at six check nakas in the Mumbai region namely Vashi, Mulund(new highway), Mulund (old highway), Dahisar, Bal Rajeshwar and Airoli. The inspectors are deputed at the check naka in three shifts on 24hr basis. If any loaded vehicle entering Mumbai region is not having Mumbai entry pass, then vigilance officers deployed at the check naka seize the vehicle and send it to the to Head Office for necessary action.

After the vehicles are sent to the Head Office, the inspector or the clerk who has caught the vehicle prepares a letter stating the details of the vehicle along with the commodities. The transporter also gives a written statement accepting the fault.

The file containing all these papers and vehicle papers are forwarded to the Secretary of MAPMC for approval. As per the directions of the Secretary, further action is taken. If the Secretary is not present, then the Deputy Secretary can take the decision with later consultation with the Secretary.

The vigilance department calls the purchaser and collects the regular market fee plus three times that amount and the related charges towards penalty. A receipt is issued to the purchaser for the amount collected. A register is maintained in which all the details are mentioned. (e.g., Item, Vehicle no, Receipt no, place where the vehicle is coming from, amount collected, etc.). The vigilance department can hold the vehicle in its custody for ninety days.

If the purchaser fails to pay the market fee within ninety days, then the deputy secretary issues a letter to the respective Market Heads to carry out the auction of commodities and send back the empty vehicle to the office. After the auction, the respective market collects the market fee and the fine amount. It is then deposited in the bank. The bank statement is forwarded to the vigilance department, which in turn forwards it to the accounts department.

If any farmers or cooperative or agricultural producing community wants to sell their products directly in Mumbai, such requests are also granted permission. For this, the concerned parties need to apply for the permission from the MAPMC showing the details of their activities like authentic farming evidence papers like 7/12 form, their vehicle details, etc. This facility is applicable only at Dahisar check naka. The concerned parties are issued three copies of permission letter. One is kept with MAPMC, other at checknaka and third one with the farmer/cooperative society. These permit holders remit the market fee at the checknaka according to the goods they are carrying. A Group Leader from the check naka deposits the money in the bank and submits a copy of the receipt to the vigilance department and the original to the accounts department. Any goods brought by railways are held and then auction carried out and the market fee plus fine is collected.

The vigilance department coordinates with the market office to carry out any inspection in the market yard. The vigilance department carries out inspection for any trade happening outside the market yard.

Weekly as well as monthly meetings are conducted to ascertain how the work has proceeded. The weekly meeting is conducted by the Joint Secretary and the monthly meeting is conducted by the Secretary.
